ADMISSIONS POLICY: All admissions are strictly through pre-bought tickets through the official Galaxia Boats website www.galaxiaboats.com Galaxia Aprumada LDA reserves the right to refuse entry to any person or remove an individual or party from the festival permitter who may be acting in any anti-social matter whatsoever. This includes all individual who is deemed intoxicated through alcohol or illegal drugs, acting in abusive manner to other guests or any member of staff or any other activities deemed inappropriate by Galaxia Aprumada LDA and its staff. No refunds will be issued whatsoever to anyone refused entry or those removed from the festival perimeter.
Galaxia Aprumada LDA: Release and Waiver.
In consideration of joining in the above-described event (the “Activity”), I agree and acknowledge that I am fully aware that participation in the Activity may involve risks. “Claims” includes but is not limited to any and all liabilities, claims, demands, legal actions, rights of actions for damages, financial or economic loss, or loss or damage to or loss of your property incurred or suffered by you directly or indirectly as a result, in whole or in part from my participation in the Activity. “Released Party” means Galaxia Aprumada LDA. and all of their parent and group companies affiliates, franchisees and their respective assignees, representatives, directors, officers, agents, sub-contractors, employees and volunteer staff. I agree and acknowledge that: (a) the Activity may be physically strenuous; (b) I am in proper physical condition to participate in the Activity; (c) I am aware that participation could, in some circumstances, result in physical injury, serious physical injury or death; and (d) I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured and will do so. Waiver and Limitation of Liability I hereby, for myself and for my heirs, next of kin, executors, administrators and assigns, fully release, waive and forever discharge any Claims, I may have now or at any other time, against any Released Party and I agree, by accepting the inherent dangers and risks associated with the Activity, not to make any Claim against or seek any compensation from the Released Parties in respect of any personal injury, illness or death suffered by me (unless such a death or personal injury is caused by the negligence of that Released Party) or damage to or loss of property I sustain as a result of my participation in the Activity; I agree to hold harmless each Released Party from any loss or liability (including any reasonable legal fees they may incur) defending any Claim (excluding personal injury or death caused by the negligence of that Released Party); I acknowledge and agree that no Released Party shall be liable for any personal injury, illness or death, unless caused by the negligence or wrongful act of that Released Party; I accept that this Release and Waiver is reasonable given the nature of the Activity. Medical disclosure I agree and acknowledge that my health and fitness needs to be appropriate for this Activity and that the Released Parties recommends: (a)I should seek medical advice if I am uncertain (b)I should not take part in the Activity against that advice. The Released Parties reserve the right to refuse any participant the right to commence or require the participant to cease participation in the Activity should they believe it necessary on medical grounds. I acknowledge and agree that if I fail to comply with the duty of medical disclosure and if the Reserved Parties would have not permitted me to undertake the Activity, or continue participation, had I made a full disclosure, the Reserved Parties will not be liable for any personal injury, death or property damage or loss I incur. Nothing in the clause excludes or limits a Released Party's liability for death or personal injury which arises as a result of such Released Party's negligence. I am aware that there is no obligation for any person to provide me with medical care during the Activity. I understand and acknowledge that: (a)there may be no aid stations available for the Activity (b)If medical care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered.
Images, Videos and Copyright
I grant my permission to the Released Party and any transferee or licensee or any of them, to utilise any photographs, motion pictures, videotapes, recordings and other references or records of the Activity which may depict, record or refer to me for any purpose (“Images”), including commercial use by the released parties, their sponsors and their licensees. This permission is for use anywhere in the world and on the internet and for an unlimited period of time. I understand and agree that I will not be compensated or receive additional consideration for consenting to the use of the Images and that I will not be given a chance to receive, inspect or approve the promotional or marketing material, messages and/or content that may use the Images. I hereby release the Released Party including, without limitation, all persons who took or otherwise created, recorded or modified the Images, from any and all claims, actions, damages, interest, costs, expense and compensation of whatsoever kind and howsoever arising, whether known or unknown, and which I now have or at any time hereafter can, shall or may have in connection with, or in any way resulting or arising from, the Images and the creation, use or disposition of them. I acknowledge and agree that the Released Party shall own all right, title and interest, throughout the world, in and to the Images and any materials compromising all or any part of the Images, and that the Released Party has the unrestricted right to use, license, sell, transfer or otherwise dispose of any or all of them, as well as the Released Party’s rights under this Release and Waiver, in any manner whatsoever and without any accountability to me. I hereby assign to the Released Party all right, title and interest, throughout the world, I may have in and to the Images and any materials comprising all or any part of the Images, including all intellectual property rights thereto. I hereby irrevocably waive any and all of my moral rights and any other irrevocable rights I may have, throughout the world, in or to the Images and any materials comprising all or part of the Images. If any provision, or part of a provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. Attendees under 18’s Year Old If the participant is less than 18 years of age, the parent or guardian agrees to the following statements: As a parent or guardian of the participant child, I authorise the child to participate. I agree that in the event the participant child, or anyone acting on his or her behalf, should make any claim, I will provide the hold harmless described and I agree to the terms of this Release and Waiver. In the event of a medical emergency involving the participant child and any Released Party is unable to contact me, I agree and grant my permission that any Released Party may provide medical care to the participant child. Waiver and Limitation of Liability Confirmation Nothing in this Release and Waiver shall exclude or limit the liability of any Released Party for death of personal injury caused by such Released Party's negligence, fraud or fraudulent misrepresentation, or for any other matter excluded by law. I have fully read and understand this agreement. I am aware that by signing this agreement, I am waiving certain legal rights I or my heirs, next of kin, executors, administrators and assigns may have against the Released Party. Data Protection Notice and Declaration The information you provide on this form will be held and processed by Galaxia Aprumada LDA. I hereby acknowledge that the information may be shared with the representatives, agents, employees or contractors of Galaxia Aprumada LDA or its affiliates for the purpose of the administration and operation of the Activity. The information you provide on this form will be held in accordance with the Data Protection Act 1998. You are responsible for the accuracy and completeness of the information supplied and in particular the supply of personal information to us. By signing below you are agreeing to the use of your personal information as described in this notice and confirming.

Event Cancellation: If Galaxia Aprumada LDA is forced to cancel this event, ticket holders and exhibitors will be automatically rolled over to the next instalment of “Galaxia Boat Show”. Under force majeure, Galaxia Aprumada LDA shall forthwith serve notice in writing to all ticket holders specifying the nature and extent of the circumstances giving rise to force majeure, and shall subject to service of such notice, have no liability in respect of the performance of such of its obligations as are prevented by the force majeure events during the continuation of such events, and for such time after they cease as is necessary for that party, using all reasonable endeavours, to recommence its affected operations in order for it to perform its obligations. In this letter, "force majeure" shall mean any cause preventing either party from performing any or all of its obligations which arises from or is attributable to acts, events, omissions or accidents beyond the reasonable control of the party so prevented including without limitation an act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, disease, epidemic, pandemic, storm or default of suppliers or sub-contractors. Under force majoré; ticket holders, traders and sponsors shall not be entitled to refunds but will be able to the next edition of Galaxia Aprumada LDA at no extra cost.
REFUNDS:
Refunds for tickets, exhibiting or partnerships are not available for cancellation or non-attendance. Any fees paid can be rolled to the following year at the discretion of Galaxia Aprumada LDA.
If you cannot attend any event or any activations whether due to personal circumstances or due to Covid-19 restrictions, you are not entitled to any automatic refunds. All refunds are discretionary - This is in line with your consumer rights.
All our contractor/vendors must be fully insured for all products and services offered and anything brought to our event site (Marina de Lagos). You must send a copy of your current, valid public liability insurance to Galaxia no later than your arrival date at the main event. You cannot participate in the show without this. By being a vendor/contractor on-site, you agree to take sole responsibility for any claims made by any participants relating to your products and services offered and to indemnify Galaxia Aprumada Lda and its associated partners and legal entities against any and all claims or losses arising from products or services offered. All equipment brought to the event “Galaxia Electric Boat Show” is entirely at your own risk and your responsibility and is NOT covered under Galaxia Aprumada Lda public liability or damage insurance.

1. TREATMENT AND SECURITY OF PERSONAL DATA(GDPR)
1.1 In compliance with the provisions of the Personal Data Protection Act, the customer of the Supplier may, at any time, exercise its rights of rectification, cancellation and communication of its data by registered letter with acknowledgment of receipt.
1.2 The customer authorizes the Supplier to automatically process the customer's personal data, including all data disclosed at the time of the Order, for the purposes necessary for the contracting and subsequent contracting stages, but always within the scope of the business, and the same may be provided, by way of example, to service providers and suppliers of the Supplier, namely accounting and audit companies.
2. PERSONAL DATA AND PRIVACY POLICY
2.1 Galaxia Aprumada Lda needs to collect some personal data from its customers as part of its business, but Galaxia Aprumada Lda respects your right to privacy and will not collect any personal information without your prior consent. Galaxia Aprumada Ltd does not sell or trade personal details of customers or users.
3. LIABILITY FOR THE PROCESSING OF PERSONAL DATA
3 Galaxia Aprumada Lda is responsible for the processing of your personal data, whether or not by automated means, from its collection, organisation, storage and disposal.
4. SECURITY AND CONFIDENTIALITY OF PERSONAL DATA
4.1 Galaxia Aprumada Lda endeavours to implement all necessary precautions to preserve the confidentiality and security of the personal data collected and processed. To this end, various physical, logical security measures have been adopted, especially with regard to information systems, in order to protect personal data against their unauthorised disclosure, loss, misuse, alteration, processing or access, as well as against any other form of unlawful processing.
5.RIGHTS OF THE PERSONAL DATA SUBJECT
5.1 In accordance with current legislation, the holder of personal data has the right to access and rectify their data, as well as the right to request their deletion.
6. RIGHT TO COMPLAIN If you consider that your data is not being processed in accordance with applicable legislation, in particular European and national legislation, we remind you that you have the right to lodge a complaint with a CNPD supervisory authority.
6.1 Galaxia Aprumada Lda reserves the right to make adjustments or amendments to this Privacy Policy and will publish any such amendments.
7. LIABILITY FOR EXTERNAL CIRCUMSTANCES
The Supplier shall not be liable for a breach of any term of this Agreement if such breach is caused by any circumstance beyond the Supplier's control.
8. PARTIAL NULLITY
If any clause of this contract is declared void or invalid, such declaration shall not affect the validity of the remainder of the contract, which shall remain in force and effect. The void clause or clauses shall be replaced or integrated into others which, being in conformity with the law, fulfil the spirit and purpose of the replaced clauses.
9. APPLICABLE LAW AND JURISDICTION
9.1 This contract, both for its application and its interpretation, is governed by the Portuguese law applicable according to the legislation in force. The language is Portuguese.
9.2 The parties commit themselves to amicably resolve any divergence that may arise with respect to the present contract. In case an amicable settlement is not possible and a judicial dispute arises, both parties agree, expressly waiving any other forum that may correspond to them, to submit to the jurisdiction and competence of the Courts of the District of the headquarters of the Supplier.

1.1 Em cumprimento do disposto na Lei de Proteção de Dados Pessoais, o cliente da Fornecedora poderá, a qualquer momento, exercer os direitos de retificação, cancelamento e comunicação dos seus dados através carta registada com aviso de recepção.
1.2 O cliente autoriza a Fornecedora a processar de modo automatizado os dados pessoais do cliente, incluindo todos os divulgados no momento da Encomenda, para os fins necessários à contratação e posteriores fases da contratação, mas sempre no âmbito do negócio, podendo os mesmos ser fornecidos, a título exemplificativo, a prestadores de serviços e fornecedores da Fornecedora, designadamente, empresas de contabilidade e de auditoria.
2. POLÍTICA DE UTILIZAÇÃO DE DADOS PESSOAIS E DE PRIVACIDADE
2.1 A A Galaxia Aprumada Lda. no âmbito sua atividade comercial, necessita de recolher alguns dados pessoais dos seus clientes, no entanto, respeita o direito à privacidade e não recolhe qualquer informação pessoal sem o prévio consentimento dos seus clientes. A Galaxia Aprumada Lda não comercializa dados pessoais de clientes ou utilizadores.
3. RESPONSABILIDADE PELO TRATAMENTO DE DADOS PESSOAIS
3.1 A A Galaxia Aprumada Lda é a responsável pelo tratamento dos seus dados pessoais, por meios automatizados ou não, desde a sua recolha, organização, conservação, até à eliminação.
4. SEGURANÇA E CONFIDENCIALIDADE DOS DADOS PESSOAIS
4.1 A Galaxia Aprumada Lda empenha-se na implementação de todas as precauções necessárias para preservar a confidencialidade e segurança dos dados pessoais recolhidos e tratados. Para o efeito, foram adotadas diversas medidas de segurança físicas, lógicas, especialmente no que diz respeito a sistemas de informação, de forma a proteger os dados pessoais contra a sua difusão, perda, uso indevido, alteração, tratamento ou acesso não autorizado, bem como contra qualquer outra forma de tratamento ilícito.
5.DIREITOS DO TITULAR DOS DADOS PESSOAIS
5.1 De acordo com a legislação em vigor, o titular dos dados pessoais tem direito de acesso e retificação dos seus dados, bem como o direito de solicitar a sua eliminação.
6. DIREITO A APRESENTAR UMA RECLAMAÇÃO Caso considere que os seus dados não estão a ser tratados em conformidade com a legislação aplicável, designadamente europeia e nacional, lembramos que tem o direito de apresentar reclamação a uma autoridade de controlo CNPD.
6.1 A A Galaxia Aprumada Lda. reserva-se o direito de, proceder a reajustamentos ou alterações à presente Política de Privacidade, sendo essas alterações devidamente publicitadas.
7. RESPONSABILIDADE POR CIRCUNSTÂNCIAS EXTERNAS
A Fornecedora não se responsabiliza pelo incumprimento de nenhum termo do presente contrato se tal incumprimento for provocado por qualquer circunstância alheia à Fornecedora.
8. NULIDADE PARCIAL
Se qualquer uma das cláusulas do presente contrato for declarada nula ou inválida, essa declaração não afeta a validade do restante contrato, que manterá a sua vigência e eficácia. A cláusula ou cláusulas nulas devem ser substituídas ou integradas noutras que, estando em conformidade com a lei, cumpram o espírito e a finalidade das cláusulas substituídas.
9. LEI APLICÁVEL E FORO
9.1 O presente contrato, quer para a sua aplicação quer para a sua interpretação, rege-se pelo direito português aplicável segundo a legislação em vigor. O idioma é o português.
9.2. As partes comprometem-se a resolver de forma amigável qualquer divergência que possa surgir a respeito do presente contrato. Caso não seja possível uma resolução amigável e seja procedente um litígio judicial, ambas as partes acordam, com renúncia expressa a qualquer outro foro que lhes possa corresponder, a sujeitar-se à jurisdição e competência dos Tribunais da Comarca da sede da Fornecedora.
